By creating an Easy TCG Lister account or using the service, you agree to these terms. If you don't agree, don't use the service.

1. What Easy TCG Lister does

Easy TCG Lister is a SaaS tool that helps trading-card sellers identify their cards using AI image recognition, look up market prices, and publish listings to their own eBay seller account. We act as a tool on your behalf — your eBay account is yours, your sales are yours, your tax obligations are yours.

Card identifications are produced by OpenAI's vision API and matched against the TCGCSV catalog. They're typically accurate but never guaranteed. You are solely responsible for what gets published to your eBay account. We are not liable for misidentified cards, mispriced listings, or eBay policy violations resulting from automatic identification.

4a. Market data & pricing recommendations

Suggested list prices are computed from publicly-available data (live eBay listings, recent eBay sold completed items, and TCGplayer market values). They are market reference data only — not financial, investment, or trading advice. Trading-card values fluctuate; outliers, stale data, and edge cases happen. You are responsible for reviewing every recommended price before publishing.

4b. Intellectual property of card images

Trading-card artwork, names, and characters are intellectual property of their respective rights-holders (e.g., The Pokémon Company, Wizards of the Coast, Bandai, Konami, and others). When you upload card images, you represent and warrant that those images and your use of them comply with applicable intellectual-property laws (including the first-sale doctrine where it applies). Easy TCG Lister does not indemnify you for any copyright, trademark, or related claims arising from your listings — those remain entirely your responsibility as the seller.

5. eBay relationship

Easy TCG Lister is an independent third-party tool. We are not affiliated with, endorsed by, or representing eBay Inc. The eBay APIs we use are publicly documented Sell APIs that any developer can integrate. Your seller fees, eBay policy compliance, and customer-service interactions with buyers remain entirely between you and eBay.

6. Service availability

We aim for high uptime but do not guarantee it. The service depends on upstream providers (eBay, OpenAI, Stripe, Cloudinary, Supabase, Railway) whose outages will affect us. We are not liable for downtime caused by third-party services.

7. Termination

You may terminate your account at any time via Settings → Danger Zone. We may suspend or terminate your account if you violate these terms, abuse the service, or if we receive a credible report that you've violated eBay's policies or applicable law. We'll typically email you first when possible.

8. Disclaimer of warranties

The service is provided "as is". To the maximum extent permitted by law, we disclaim all warranties — including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

Our total liability to you for any claim arising out of these terms or your use of the service is capped at the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater. We are not liable for indirect, incidental, or consequential damages — including lost sales, lost listings, or buyer disputes.

10. Governing law

These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in California.

11. Changes

We may update these terms. Material changes will be announced via email at least 30 days before they take effect. Continued use of the service after the effective date constitutes acceptance.
